Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of YonoLMS's website, applications, and related services (collectively, the "Services"). By creating an account or otherwise using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a school, district, or other organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 13 years old to create an account directly. Students under 13 may use the Services only through an account provisioned and supervised by their school, teacher, or a parent or guardian who accepts these Terms on the student's behalf.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@yunolms.com if you suspect unauthorized use of your account.

You agree not to:

• Use the Services to violate any applicable law or the academic integrity policies of your institution;
• Circumvent or attempt to circumvent anti-cheat, proctoring, or exam-integrity features;
• Upload content that infringes intellectual property rights or contains malicious code;
• Reverse engineer, scrape, or resell access to the Services without our written consent; or
• Interfere with the operation or security of the Services or other users' accounts.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other users.

You retain ownership of the quizzes, assessments, course materials, and other content you upload or create using the Services ("User Content"). You grant YonoLMS a limited, non-exclusive license to host, process, and display User Content solely to operate and improve the Services.

YonoLMS, our logo, and the Services' underlying software, design, and AI models are owned by YonoLMS or our licensors and are protected by intellectual property laws. No rights are granted to you except as expressly set out in these Terms.

The Services use artificial intelligence to help generate questions, grading suggestions, and feedback. While we design our models for high pedagogical accuracy, AI-generated content may occasionally contain errors. Educators are responsible for reviewing AI-generated assessments and grades before relying on them for official academic records.

Certain features of the Services require a paid subscription. Fees, billing cycles, and renewal terms will be presented at the time of purchase. Unless otherwise stated, subscriptions renew automatically until cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YonoLMS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You may stop using the Services and close your account at any time. We may suspend or terminate your access to the Services if you breach these Terms, upon reasonable notice where practicable. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

We may modify the Services or these Terms from time to time. We will post updated Terms on this page and update the "last updated" date above. Material changes will be communicated through the Services or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by applicable local law without regard to conflict-of-law principles, and any disputes will be subject to the exclusive jurisdiction of the competent courts, except where applicable law requires otherwise.
